Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Verifence (the "Service"). By creating an account or calling the API, you agree to these Terms. If you are using the Service on behalf of an organization, you accept these Terms on its behalf.

2. The Service

Verifence is a pre-send decision API. You call it before handing a message to your own SMS provider, and it returns an allow/deny verdict. Verifence does not send messages and is not your telecommunications provider. The Service is provided on a best-effort basis and is designed to fail open: if our systems are degraded, requests may be allowed so your own flows are not interrupted. We do not guarantee that all fraud or abuse will be detected.

3. Accounts & API keys

You are responsible for all activity under your account and API keys. Your API key is a secret credential intended for server-to-server use only; you must keep it confidential and must not embed it in client-side or public code. You are responsible for any usage or charges resulting from a leaked or misused key. Revoke and rotate keys you believe may be exposed.

4. Plans, billing & quotas

  • Paid plans are offered as recurring subscriptions billed monthly or annually in advance, and renew automatically until cancelled.
  • Each plan includes a monthly quota of API checks. The quota resets at the start of each billing period, which is anchored to your subscription (or, on the free plan, your signup date).
  • Unused checks do not roll over. Any portion of your quota not used within a billing period expires at the end of that period and is not credited, carried forward, or refunded.
  • If you exhaust your quota, further checks may be rejected until you upgrade or the quota resets. Upgrading raises your quota immediately.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
  • We may change prices or plan limits with reasonable notice; changes apply from your next renewal.

5. Acceptable use

You agree not to use the Service to violate any law, to send unlawful or unsolicited messages, to interfere with or overload the Service, or to attempt to circumvent quotas, security, or access controls. You must only submit data you are entitled to process, including end-user phone numbers and IP addresses.

6. Data & privacy

By default the Service stores no personal data in the clear: phone numbers are hashed before use and are not retained. Optional logging features, where enabled by you, are tenant-isolated and subject to the retention you configure. You are the controller of the end-user data you submit and are responsible for having a lawful basis to submit it.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect or prevent all fraudulent or abusive traffic. You remain responsible for your own SMS provider charges.

8. Limitation of liability

To the maximum extent permitted by law, Verifence will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any messaging charges, lost profits, or lost revenue. Our total liability arising out of or relating to the Service will not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and your continued use after they take effect constitutes acceptance.
